At Zuo Yue Zi Care, our mission is to foster a supportive community for expectant parents and families by providing access to culturally competent care and services designed to help them thrive. Through our platform, we connect users with a diverse range of caregivers, including but not limited to birth doulas, postpartum doulas, Yue Saos, nannies, lactation consultants, cooks, housekeepers, sleep consultants, and other domestic service providers (collectively, “Caregivers”).

By enrolling in our Premium Membership (“Membership”) program, you gain access to our network of Caregivers and the opportunity to engage and retain their services. Your use of the Membership and Services constitutes your agreement to these Terms, as well as your acknowledgment of responsibility for compliance with all applicable local laws.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

As a user, you are solely responsible for conducting your own due diligence to ensure that the caregiver you select meets your specific needs and complies with all applicable laws, regulations, and licensure requirements. Zuo Yue Zi Care is not a substitute for legal, tax, or employment law advice.

YOU ARE RESPONSIBLE FOR SELECTING YOUR CAREGIVER.

You are solely responsible for evaluating and determining whether a caregiver is suitable for your needs based on their specialty, experience, certifications, licenses, work authorization, and other relevant qualifications.

NO GUARANTEE OF ENGLISH-SPEAKING CAREGIVERS.

Zuo Yue Zi Care specializes in providing culturally competent care rooted in traditions from around the world. Due to high demand, English-speaking caregivers may be hired quickly and may charge higher rates. Enrollment in the Membership or use of the Services does not guarantee the availability of bilingual or English-speaking caregivers.

NO GUARANTEE OF COMPENSATION RATES.

Zuo Yue Zi Care does not control caregiver compensation rates, which are subject to market fluctuations driven by supply and demand. Enrollment in the Membership or use of the Services does not imply or guarantee specific compensation rates. Users are encouraged to pay prevailing wages in their area and understand that actual rates may exceed these averages due to market conditions.

Zuo Yue Zi Care does not provide consultation or guidance on employment classification. Employment classification laws vary by state and may include distinctions between employees and independent contractors. Users are advised to consult a certified public accountant (CPA) or employment attorney for clarification and compliance.

Caregivers have the right to work in a safe environment free from abuse, harassment, or retaliation. Failure to provide such an environment may result in the termination of contracts or employment. Additionally, failure to fulfill contractual obligations, unlawful termination, or engaging in disparaging remarks, slander, or libel against a caregiver may result in legal action.

To assist you in finding caregivers who may meet your specific needs, we provide profiles of caregivers that align with the criteria you have listed. However, it is solely your responsibility to evaluate and select a caregiver who fits your needs and circumstances.

At this time, we do not verify whether caregivers listed on the Services hold active licenses, certifications, or registrations required by law to practice their respective specialties. Additionally, we do not verify caregivers’ professional histories, insurance coverage, or their suitability for your specific needs. YOUR SELECTION OF A CAREGIVER IS MADE AT YOUR OWN RISK.

We do not recommend, endorse, or make any representations or warranties regarding any caregiver or the quality of the services they may provide. We cannot guarantee that caregivers listed on the Services are qualified, licensed, or certified to perform the services they offer.

Zuo Yue Zi Care facilitates direct communication between you and caregivers, allowing you to contact, interview, meet with, and hire caregivers independently. However, sharing your account with multiple users or using our referrals for personal monetary gain outside of Zuo Yue Zi Care is strictly prohibited and constitutes a breach of these Terms of Service. In the event of such a breach, we reserve the right to take appropriate action, including but not limited to charging you the full annual membership fee, imposing applicable cancellation fees, and/or suspending or terminating your subscription.

When using the Services, you agree to refrain from engaging in any conduct that violates applicable laws, regulations, or the rights of others. Specifically, you agree that you will not:

The Site may include various communication tools and features (collectively, “Communication Services”). By using the Communication Services, you agree to use them solely for lawful and appropriate purposes.
When using the Communication Services, you agree that you will not defame, abuse, harass, stalk, or threaten others; publish inappropriate or unlawful content; upload files containing viruses; or harvest information about others without consent.

Zuo Yue Zi Care does not assume responsibility for verifying the claims or qualifications of caregivers. It is your sole responsibility to thoroughly vet any caregiver prior to hiring. For an additional fee, Zuo Yue Zi Care may assist in facilitating certain verification processes, but Zuo Yue Zi Care does not conduct criminal background checks or identity verification.

To access the features of the “Zuo Yue Zi Care Premium Membership,” clients are required to subscribe to a Subscription Plan. This subscription is set to automatically renew.

ALL SERVICES ARE OFFERED “AS IS” AND “AS AVAILABLE.” ZUO YUE ZI CARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Any disputes shall be resolved exclusively through final and binding arbitration under the Federal Arbitration Act. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST ZUO YUE ZI CARE ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER.
